Who does a Licensed Insolvency Trustee work for?

A Licensed Insolvency Trustee has a duty to all parties involved in an insolvency proceeding, including you, your creditors, the regulatory body that oversees insolvency in Canada (the Office of the Superintendent of Bankruptcy) and the Court. Essentially the Trustee doesn’t work for just one specific party but are obligated to make sure that all interests are fair for all parties. There are Codes of Ethics for trustees outlined in the Bankruptcy and Insolvency Act that requires them to be “not prejudiced to any particular party… be fair and unbiased…”

How does a Licensed Insolvency Trustee get paid?

Fees for Licensed Insolvency Trustee services for bankruptcy and consumer proposal are highly regulated and set by the government tariffs. Trustees cannot select their own fees or rates and are calculated and drawn from the funds a debtor has paid into each individual bankruptcy estate or consumer proposal. This regulated approach ensures the costs of LIT services are the same, regardless of the firm you select.
